Monte Vista Condominium Owners' Association Community Rules

Adopted January 21, 2014

The following rules and regulations are intended as a supplement to the Association CC&Rs, but are not a substitute for that document. The CC&Rs should also be read carefully read.

1.   Signs

All signs displayed in the Project shall be attractive and compatible with the design of the Project and shall comply with all applicable state and federal laws and local ordinances. The only signs of any kind may be displayed to the public view on or from any Unit or the Common Area shall be as follows:

  • Legal Proceedings: Signs required by legal proceedings may be displayed 

  • Non-Commercial: Non-commercial signs, posters, flags, or banners may be displayed in accordance with the provisions of California Civil Code Section 1353.6. Any such sign or poster may not exceed nine (9) square feet in size and any such flag or banner may not exceed fifteen (15) square feet in size.

  • Project Identification: Appropriate signs may be displayed by the Association to identify the Project;

  • Sale or Rent: One (1) sign of reasonable dimensions may be placed within the window of a Unit advertising the Condominium for sale or rent; and

  • Signs Approved By Board: Other signs, posters and notices approved by the Board or specified in the Operating Rules or in this Declaration may be posted in locations designated by the Board.

  •  Small security signs are allowed in the unit's windows only as long as they are informing of the presence of a security system in place.

2.  Deck Covers

Deck covers may not be installed unless approved by the Architectural Committee.

3.   Window Coverings

Normal and customary window coverings are permitted, provided that the exterior side of any drapes, window shades or other window coverings visible from the Common Area or the streets and drives within the Project must be white, off-white, or natural wood tones, unless otherwise approved by the Architectural Committee. Residences may remain for the useful life thereof. All window coverings shall be installed within thirty (30) days after the conveyance of the Unit.

4.   Holiday Decorations

Holiday decorations are permitted, provided that they are mounted in a way that does not involve penetration of any common area surface or any other damage to a common area component. Holiday decorations may be displayed no more than 30 days prior to the applicable holiday, and must be removed within 15 days after the holiday.

5.   Waste and Recycling Materials

 All garbage, trash and accumulated waste material must be placed in appropriate covered containers. Containers for recyclable materials need not be covered. Any containers provided by the Association may be stored in locations designated by the Board. Containers provided by Owners, if any, can be placed on Common Area or where visible only on the day that pick-up is to occur. All such containers will be kept in a clean and sanitary condition. Boxes must be broken down prior to being placed in the containers. 

6.   Hobby Shops and Power Equipment

No power equipment, hobby shops, or vehicle maintenance (other than emergency) shall be permitted on the Project except with prior written approval of the Board. Use of portable power tools or yard maintenance equipment shall be permitted during reasonable hours of the day, if the use is conducted in a manner as to avoid any unreasonable noise, dust, fumes, or hazard adversely impacting neighboring Lots. 

7.   Sports Equipment

No basketball standards, fixed sports apparatus or similar equipment shall be attached to the exterior of any Unit or permanently place within any Exclusive Use Common Area, except in accordance with the provision of Article XI (Architectural and Landscaping Control). Portable or movable basketball equipment or other movable sports apparatus may not remain overnight where Visible from adjacent Units or streets without prior approval of the Board. 

8.   Clotheslines Policy

No exterior clotheslines or other outdoor facilities for drying clothes shall be permitted on any Lot. There shall be no exterior drying or laundering of clothes within any Lot, or within any balcony, deck, patio, or porch situated on a Lot. 

9.   Exterior Storage 

No storage of any kind shall be permitted on patios and decks with the exception of patio furniture and gas BBQs. Charcoal BBQs are NOT permitted. Patios and decks must be kept in an orderly condition at all times. No storage of any kind shall be permitted in the common area or parking space for the podium unit owners.

10.    Animals

 An Owner may keep two (2) customarily uncaged household pet within the Owner's unit. Each Owner may also keep a reasonable number of small caged animals, birds, or fish. Unless the Operating Rules increase the number of type of animals that may be kept, no other animals or pets are permitted in the Project. The Board shall have the right to prohibit the keeping of any pet which, after Notice and Hearing, is found to be a nuisance to other Owners. No animals may be kept for commercial purposes. No dog shall be allowed in the Common Area unless it is under the control of a responsible person by leash. Each Owner or Invitee must clean up after its pet so that the Common Area is in the same condition it was in immediately preceding its use by any pet permitted on the Common Area by the Owner or Invitee. No pets are allowed under any circumstance where there are signs prohibiting their presence, if a pet needs to go to the bathroom they are not, under any circumstances to use the areas with signs prohibiting them. 

11.   Items on Decks

 No storage of any kind shall be permitted on the exclusive use decks, with the exception of patio furniture and gas grills, provided that coasters must be placed on all grill, table and chair legs. Pots and planters must be raised off of deck surface and coasters must be placed on all plant stand legs/wheels. Residents may NOT place items such as welcome mats, tile, indoor/outdoor carpet or charcoal grills on deck surface. Residents must ensure that high heel shoes are not worn on deck surface. In podium units, up to 2 (two) bicycles can be stored if they are in good operating condition and kept below the upper height of the balcony railing.

 12.    Abandoned Bike Policy

Bicycles should not be left unattended in the common area. Bicycles found within the Monte Vista Condominium Owners Association abandoned or with missing parts (seat, handlebars, wheels, etc.) will be considered abandoned. These bikes will be removed and donated to charity. It is the responsibility of the owner and or resident to not leave their bikes unattended in the common area.

 13.    Water Intrusion

 If the Unit Owner discovers water intrusion into the building structure or wall interior, the Owner must notify the Association IMMEDIATELY, regardless of the cause of the water intrusion.

 A.    If the water intrusion results from a leak in a component within the wall and     the homeowner contracts the repair, the Owner may NOT close the opening in the wall without written permission from the Association. If the Owner does close the opening, and further inspections or repairs of the wall interior are required, the Association will re-open the wall and the Owner will be responsible for the extra costs incurred if the leak was the responsibility of the owner. (In this situation, the association will not re-finish the interior surfaces, such as paint, flooring, and carpet).

Depending upon the nature and location of the damaged component, either the Association or the Owner may be responsible for maintaining it. The Association will determine maintenance responsibility and notify the Owner:

  1. If the damaged component is the Owner's maintenance responsibility, the Owner will be responsible for the cost of all repairs, and will be responsible for performing cosmetic restoration of the interior surfaces inside the Unit after repairs are complete.

  2. If the damaged component is the Association's maintenance responsibility, the Association will be responsible for the cost of the repairs (other than any extra costs necessitated by the Owner's unauthorized work). Neither the Association nor its insurer may be responsible for the contents of your home or its interior surfaces, provided there was no neglect on the part of the Association. THEREFORE, MAKE SURE YOU HAVE YOUR OWN HOMEOWNERS' INSURANCE POLICY IN PLACE, AND HAVE YOUR INSURER ENSURE THERE ARE NO GAPS IN COVERAGE.

B.   If the water intrusion originates within the Owner's Unit (overflowing sink, appliance leak, etc.), repairs will be performed as described above, and the Owner may not close the opening in the wall without written permission from the Association. The Owner will be responsible for the cost of all repairs, and will be responsible for restoring the interior surfaces of the Unit. 

For Podium Units: 

14.   Trash Chutes

All materials placed in trash chutes must be securely bagged. No liquids may be dumped into the chutes. No heavy, sharp, or loose objects may be dumped down the trash chutes.

15.    Large Item Deliveries

Residents may not transport heavy or bulky items through the elevators, or authorize such transport, unless the elevator walls have been appropriately padded. Such items include, but are not limited to, furniture, appliances, and construction materials. The same policy applies to any other large item that might have the potential to damage the elevator.

16.  Lockboxes

All lockboxes must be approved by the management company before they are installed. All lockboxes can only be installed at the lockbox designated area, after approval. Any lockboxes installed without approval or not removed within the specified time frame, will be removed without further notice.
